GENERAL RENTAL CONDITIONSATION - SAS ANJ

The boat is booked when the client has returned the completed booking form, the required deposit (30% of the total amount) and the booking form of the rental), and that SAS ANJ has returned to the hirer a confirmation of his reservation.

Article 2 - Regulation

The hirer shall pay the balance of the rental at the latest one week before the rental period. The sums paid shall be retained by the lessor in the event of cancellation by the lessee for any reason whatsoever, and in particular in the event of the rental period and, in general, all the terms and conditions of this contract may only be modified with the agreement of the lessor. In the event of damage occurring during the previous period or when an impediment is reported with anyone beyond his control, the lessor will not be able to give the hirer the use of the boat on the agreed date and he will have the right to either provide the hirer with a replacement boat or to make the hirer pay for a replacement boat the Tenant may either choose to rent the property in substantially equivalent dimensions or to return the sum paid without the Tenant being entitled to claim damages or interest. This restitution will be proportional to the period of deprivation of use.

Article 3 - Insurance

The lessor certifies that the owner of the boat has taken out insurance covering the lessee, subject to the excess (amount stated in article 3), for any damage he may cause to the boat or its equipment, and for recourse by third parties for both material damage and physical damage. This insurance does not cover the persons carried on board, nor their personal property. The lessor accepts no responsibility for any loss or damage suffered by the lessee, his guests and, more generally, any person on board the boat.

Article 4 - Deposit/Condition of the vessel

The Hirer is obliged to return the vessel and its equipment in good condition, except for any indications made in the inventory on departure. On return of the boat :

• If the boat and its equipment are in good condition, according to the inventory, the deposit will be returned within 2

working days after the return.

• If the boat and some of its equipment are damaged or missing, the hirer must pay the lessor

the restoration or replacement of the same.

• If the boat and its equipment are not in a perfect state of cleanliness, the hirer is obliged to pay the costs of

if the damage or loss is the result of a loss covered by the insurance policy provided for in Article 3, the hirer shall be obliged to pay the lessor the costs not covered by the insurance: excess, management, etc of the damage + a fixed fee of 250 €, guarding, etc.

• In the event of damage during the rental period, whether or not resulting from normal wear and tear of the equipment, the hirer is authorised to

take the initiative to repair the equipment on the spot, under his responsibility, and provided that the amount of the repair does not exceed 10% of the deposit. If the damage is the result of normal wear and tear of the equipment, these costs will be refunded by the lessor as soon as possible. The hirer undertakes to return the boat one day earlier in case an intervention is necessary, in order not to delay the next hirer.

• In the event of serious or major damage (engine breakdown, water ingress) the hirer is obliged to take all measures

the hirer is obliged to take urgent action to prevent the damage from getting worse and to notify the insurance company or its representative AND the lessor as a matter of urgency, pending instructions. Pending instructions, the hirer is obliged to have a report drawn up by a damage report. If the hirer fails to do so, he may be required to pay the full amount of the costs incurred by the damage.

In case of disagreement on the amount of repairs or replacements, an expert will be appointed by the lessor, at the expense of the lessee.

Article 5 - Use of the boat

The hirer declares that he/she has the knowledge and experience necessary for the navigations that he/she is going to carry out, and the permits that may be required for the operation of this boat. The lessor reserves the right to refuse to make the boat available if the skipper and the crew do not seem to have sufficient experience or knowledge, or for any other reason of which he is the sole judge, and in particular the marine weather. In this case, the lessor will propose to the lessee either a skipper at the lessee's expense, or to rent the boat "a quai", with an absolute ban on moving the boat. The Hirer undertakes to use the boat in accordance with French regulations and those of the countries visited, and, more generally, to use it responsibly and peacefully. He undertakes to embark only the number of authorised persons, to use the boat only for the purpose of boat than in pleasure sailing, excluding any commercial operation or participation in a competition even as an organiser. Subleasing and lending are not permitted. In case of seizure of the rented boat, the hirer will be the hirer shall be obliged to pay the lessor a sum proportionate to the amount of the hire. Article 6 - Delay

The lessee is obliged to return the boat to the lessor on the date and at the time stipulated in the contract, empty of the lessee's belongings, and in perfect condition. For each day of delay, the lessee shall owe the lessor a sum equal to double the daily price of the present rental, options included. If the lessee is unable to bring the boat back to the port of return at the specified time, he must notify the lessor at least 24 hours in advance, failing which he will owe the lessor an additional indemnity of two days' rental. If the hirer is not able to bring the boat back to the port of return himself, he shall, at his own expense and risk, ensure its safekeeping and have it brought back by a qualified provider. Late arrivals will be charged at the above rate. For daily rentals, arrivals after 6 p.m. will be penalized by 10% of the amount of the rental fee for each half hour of delay.

Article 7 - Options

Article 8 - Consumables

Fuel, batteries, gas, water supply and, more generally, all consumables are at the hirer's expense: the boat is supplied by the lessor with a full tank of fuel, and, in general, all consumables are supplied, and the hirer is required to return the boat in the same condition. Failing this, these consumables will be invoiced and deducted from his deposit + a fixed fee of 50€.

Article 9 - Domicile

For any dispute relating to the execution of this contract, and in the event that, after an attempt at amicable agreement, if no solution is found, the legal proceedings will be carried out exclusively at the court of Draguignan.
